Off Track Betting in New York State has been racing into a crisis called shrinking revenue. Some people have spitballed a solution: Don’t close on holidays.
New York State Racing Law bars racing on Christmas, Easter and Palm Sunday, and the state has ruled OTBs can’t handle action on those days, even though they could easily broadcast races from out of state.
“You should be able to bet whenever you want,” said Jackson Leeds, a Nassau OTB employee who makes an occasional bet. He added some irrefutable logic: “How is the business going to make money if you’re not open to take people’s bets?”
Elias Tsekerides, president of the Federation of Hellenic Societies of Greater New York, said OTB is open on Greek Orthodox Easter and Palm Sunday.
“I don’t want discrimination,” Tsekerides said. “They close for the Catholics, but open for the Greek Orthodox? It’s either open for all or not open.”
OTB officials have said they lose millions by closing on Palm Sunday alone, with tracks such as Gulfstream, Santa Anita, Turf Paradise and Hawthorne running.
One option: OTBs could just stay open and face the consequences. New York City OTB did just that back in 2003. The handle was about $1.5 million – and OTB was fined $5,000.

religion in politics is one thing, but religious

preference in the law of the State of New York, see NY PML Sec 109 is another.
Blacks, Jews, and Thompon's old man, the lawyer, should see that Nassau OTB does not close on Roman Catholic Palm Sunday in preference to Greek Orthodox Palm Sunday. Ditto for Easter Sunday.

NY PML Sec 109 does not pass the laugh test let alone scrutiny per NY Const. Art. 1, Sec. 3

Old man Thompson remembers when NYC OTB was not bankrupt and people had the chance to work and make money and/or bet if they wished. 


Thompson and Thompson should do the right thing and see that religious preference does not appear in the laws of the State of New York.

Mr. Thompson, an Episcopalian, is the only African-American candidate in the 2013 mayoral campaign, and he is focusing much of his effort on rallying support from blacks and Hispanics. But he is also claiming an edge among one of New York City’s fastest-growing groups: Orthodox Jews, who are up for grabs in the election and are concentrated in the very Brooklyn neighborhoods that Mr. Thompson’s father represented as a legislator and that he has frequented since he was a boy.
“I still remember his bar mitzvah,” joked Ben Barber, an observant Jew who owns a linen business in Borough Park.
The wide-open Democratic primary race promises to be a bit of a free-for-all, in which the candidates, with few ideological distinctions among them, jockey for advantage among the many neighborhoods and demographic groups that make up the electorate. Mr. Thompson’s courtship of Jewish voters is emblematic of calculations being made by all of the candidates: perhaps 600,000 New Yorkers are expected to participate in the Democratic primary, and many of those voters are expected to be black or Jewish.
For the first time in years, no major Jewish candidate is running for mayor. Mr. Thompson, a former city comptroller, Board of Education president and deputy Brooklyn borough president, is pushing for Jewish support.
Jews outside Manhattan could constitute one-sixth of primary voters, according to demographers, and of that group, maybe 30 percent are from the fast-growing Orthodox population, mostly in Brooklyn.
“I think Billy is going to surprise a lot of people in terms of his support in the Jewish community,” said William E. Rapfogel, the politically connected executive director of the Metropolitan Council on Jewish Poverty. “He’s extremely well liked by the Jewish community, and he’s built up a lot of credibility and good will over the years.”
In the 2009 mayoral race, as the Democratic nominee, Mr. Thompson held his own among Jewish voters against Michael R. Bloomberg’s $100 million third-term juggernaut. Whereas Mayor Bloomberg had trounced Fernando Ferrer in Brooklyn’s Orthodox neighborhoods in 2005 by five to one, Mr. Thompson lost by just two to one, and drew almost even in Crown Heights and Williamsburg, said John Mollenkopf, director of the Center for Urban Research at the City University of New York.
Ask Orthodox leaders about Mr. Thompson and the responses are uniformly warm. He was there as a child when his father forged alliances with religious leaders. He helped to defuse tensions after the Crown Heights riots. He fought for Orthodox Jews’ interests on education and business issues. And last month, he was the only Democratic candidate at a news conference denouncing Brooklyn College for a discussion of a movement that advocates boycotts of Israel.
That familiarity began with Mr. Thompson’s father, William C. Thompson Sr., who, as a state senator, city councilman and judge, represented an evolving swath of central Brooklyn, beginning in the 1960s.
Mr. Thompson’s father, who still practices law, routinely resorted to Yiddish phrases. Also, his father’s second wife, Sybil Hart Kooper, a state appellate judge who died in 1991, was Jewish.
“It goes back to when I was a child,” Mr. Thompson, 59, said in an interview. “I remember being in the car with him — was I 14? — and going to Crown Heights. Even to this day, people that you meet say, ‘I remember when you were a teenager.’ ”
As an aide to Representative Fred Richmond (whose career was later derailed by corruption charges), and then the Brooklyn Borough President Howard Golden, Mr. Thompson served as an emissary to Orthodox neighborhoods.
Never were his diplomatic skills more in demand than in 1991, when Mr. Golden tracked him down on vacation in France and asked him to return immediately to pacify black and Jewish activists because, Mr. Thompson recalled, “Crown Heights was burning.”
“He was helpful as someone who represented authority yet had a common background, or a common race, who manifested a desire to keep things calm, and reason with people,” said Milton Mollen, a deputy mayor under David N. Dinkins. “Excellent temperament.”
After the Crown Heights riots, Mr. Thompson was active with the organization Blacks and Jews in Conversation, which was co-founded by his father, then an appellate judge. He also found ways, as the Board of Education president, to supply yeshivas with computers and supplies and to ease bus rules for students in religious schools, said Rabbi Jacob Goldstein, the longtime chairman of Community Board 9 in Crown Heights.
Orthodox Jews are hardly monolithic, thanks to divisions among the Satmars and differences among Russian immigrants, Bukharin Jews and others. But there could be 30,000 Orthodox voters in the Democratic primary this year, and they often vote in blocs, said Councilman David G. Greenfield, a Democrat who represents Borough Park and Midwood.
And while Mr. Greenfield has not endorsed anyone, he said he believed that voters would consider longstanding friendships and issues like child care, education and religious liberty.
In the 2001 Democratic primary for comptroller, Mr. Thompson defeated a better-financed candidate, Herbert E. Berman, a Jewish Brooklyn councilman. Mr. Berman said Mr. Thompson “very intelligently kept up his ties with the Orthodox community, and as a consequence, when I felt I should have gotten the endorsement of the Jewish press, they didn’t endorse either of us.”
Mr. Thompson said he was the first comptroller to make city investments in Israeli bonds. He also took part in a panel, at a 2007 conference of the American Israel Public Affairs Committee headlined by Vice President Dick Cheney, on financial sanctions against “Iran and other state sponsors of terror.”
Early this month, Mr. Thompson was the subject of a lengthy profile, in Hebrew, by an Orthodox magazine, Bakhila. And in December, Mr. Thompson made quite an impression by attending two Hanukkah events in Brooklyn and Manhattan, scheduled for the same hour, and drawing rousing receptions at both.
“Thompson’s reputation walked into the room before he did,” said Jonathan Greenspun, who served as Mr. Bloomberg’s unofficial liaison to the Orthodox community, and was an informal adviser during the 2009 campaign against Mr. Thompson. “Jewish leaders want you to show up, and they want to know: ‘Does this guy get me? Does he understand who I am and what my needs are?’ And a guy like Thompson — that familiarity, that credibility — is there, without question.”
Of course, all of the declared and presumed Democratic candidates are reaching out to Jewish voters. For instance, Bill de Blasio, the public advocate and a former councilman with Borough Park ties, has been attuned to issues grating on Orthodox Jews, like business fines and parking. Christine C. Quinn, the Council speaker, met recently with Orthodox women who own or manage businesses in Williamsburg. John C. Liu, the comptroller, has tirelessly attended community events.
But at a breakfast with Mr. Thompson at his house in Midwood, Chaskel Bennett, a businessman, used Yiddish to differentiate Mr. Thompson from other politicians. Mr. Thompson, he said, was a “mensch” and had never asked for a dime. Others, by contrast, were “schnorrers” — transactional officials who begged for dollars and votes but did not reciprocate when help was needed.
Mr. Thompson, nodding, noted that he went to middle school a few blocks away. “This isn’t about relationships from 5, 10 years ago,” he said. “This is my life.”
Mr. Bennett added that many voters had “buyer’s remorse” about 2009, because they believed the Bloomberg administration was too Manhattan-centric and ruthless in levying fines and fees.
“There are a lot of people in the Orthodox Jewish community who feel that maybe our relationship with Gracie Mansion, with City Hall, would be a lot better had Bill won the election,” he said. “Good friends are hard to find, and Bill Thompson is a friend.”

Andrew Cuomo usurps the power of.... and denies


the State of New York and its subdivisions money from its public benefit corporations. When tracks are running bettors want to bet. If the OTBs are not open there is no money bet at them. If you do not want to bet, don't. If you do not want to work, don't.  Andrew Cuomo can't pick and chose one Easter Sunday over another and one Palm Sunday over the other.

In Battling Tax Dodgers, Britain Gives Shame a Try

LONDON — A hairdresser in Liverpool and a knitwear manufacturer in Nottingham were among the first nine people and companies publicly branded tax scofflaws by the British authorities as part of a government “name and shame” campaign.

Prime Minister David Cameron said that people who tried to avoid paying taxes “need to wake up and smell the coffee.”
On its Web site, Her Majesty’s Revenue & Customs on Thursday published the names and addresses of accused tax cheats, along with the amount the department says they owe. The individuals and small businesses owe a combined £1.8 million, or $2.7 million, in fines and unpaid taxes. The department said the list would be updated every three months.
The campaign is intended to encourage Britons to pay their taxes in full and put pressure on tax dodgers to come forward, the government said, but some lawmakers and pressure groups argued that it failed to address the real problem in Britain: tax avoidance strategies used by large corporations.
“The publication of these names sends a clear signal that cheating on tax is wrong and reassures people who pay their taxes — the vast majority — that there are consequences for those who refuse to tell Her Majesty’s Revenue & Customs about their full liability,” David Gauke, exchequer secretary to the Treasury, said in a statement.
Executives of Starbucks, Amazon and Google were questioned by lawmakers in November over concerns that the companies were not paying enough tax in Britain, given the sales they generate here. The companies responded that they had been unfairly singled out, but a month later Starbucks bowed to public pressure and said it would pay more corporate tax in Britain.
Going after tax cheats and making it harder for individuals and companies to find loopholes in the tax system is one of Prime Minister David Cameron’s top goals. At a time of austerity — and when average households are increasingly squeezed by rising electricity and food prices — the government is under pressure to be seen as doing more to limit tax evasion and avoidance. In January, Mr. Cameron said those avoiding taxes “need to wake up and smell the coffee.”
Britain missed out on £5 billion in revenue in the tax year that ended in 2011 because of tax-avoidance methods and about £4 billion from tax evasion, according to the tax authorities. The Public Accounts Committee, a group of lawmakers representing the largest political parties, called on the authorities Tuesday to consider naming and shaming those who promote tax avoidance strategies to make them less attractive to individuals and companies.
The nine names published on the Web site also include a wine merchant, a grocery store and a bus operator. UK Uncut, a campaign that combats tax avoidance, said the step showed the authorities “spent time and money going after small companies that avoid tax, but so far we’ve seen no serious action from the government to claw back the billions avoided by global giants.”
Chris Morgan, head of tax policy at KPMG in London, said the naming and shaming campaign was a “perfectly reasonable step” and would help to deter people from not declaring their full income. The tax bills of large corporations are a different matter because companies generally declare their income properly, he said, but their tax obligations can be interpreted in different ways.
Judith Freedman, a professor of taxation law at Oxford University, agreed.
“The people who have been named on the Web site deliberately evaded taxes” and were penalized for it, she said, adding that there was “no penalty you could levy against the big companies.”
“So far, no one has proven that they have done something wrong,” she said. “You might not like what they do, but it is no secret.”

Elias Tsekerides, president of the Federation of Hellenic Societies of Greater New York, said OTB is open on Greek Orthodox Easter and Palm Sunday.
“I don’t want discrimination,” Tsekerides said. “They close for the Catholics, but open for the Greek Orthodox? It’s either open for all or not open.”
OTB officials have said they lose millions by closing on Palm Sunday alone, with tracks such as Gulfstream, Santa Anita, Turf Paradise and Hawthorne running.
One option: OTBs could just stay open and face the consequences. New York City OTB did just that back in 2003. The handle was about $1.5 million – and OTB was fined $5,000.
Easy money.

The feds are grilling state Senate Democratic insiders as part of an explosive probe into an alleged Aqueduct casino bid-rigging scandal, The Post has learned.
Investigators are asking questions about the roles of then-Senate Democratic leaders John Sampson and Malcolm Smith and others who were accused of helping the Aqueduct Entertainment Group (AEG) land a multibillion-dollar casino contract three years ago, sources said.
The state ultimately rescinded the contract in 2010 amid a state inspector general’s probe into claims of favoritism. The IG’s office referred its scathing findings to federal authorities for potential prosecution.

The state subsequently selected Genting, an international gambling firm, to operate the Aqueduct slots casino.
It’s the second federal probe targeting Sampson. The Post last week reported that the former Senate minority leader is linked to a broader federal investigation into Queens Rep. Gregory Meeks and a convicted real estate developer, Edul Ahmad.
Smith, who has talked about running for mayor on the Republican line, also is being targeted as part of the Meeks inquiry, a law-enforcement official said.
FBI agents recently interviewed witnesses about the Aqueduct case who were captured on wiretaps talking to other subjects convicted on corruption charges — including ex-state Sens. Carl Kruger and Hiram Monserrate and lobbyist Richard Lipsky.
“The line of questioning was about the Aqueduct deal,” said one Senate Democratic source familiar with the case.
“They asked about John Sampson, Malcolm Smith, Eric Adams and Carl Andrews,” the source said of FBI agents. “They said, ‘What do you know about these people and their role in the Aqueduct deal?’ ”
Adams was chairman of the Senate Racing and Wagering Committee when AEG was awarded the bid. Andrews, a former Brooklyn state senator, was AEG’s lobbyist.
The Senate Democratic insider said the feds appeared to be looking at developing potential conspiracy charges for setting up the contract for AEG.
In the IG report, Sampson was slammed for tainting the process by leaking a confidential bidding document to AEG’s lobbyist, Andrews, that included the detailed plans of rival bidders.
At the time, Sampson insisted he did not leak privileged information. But the IG report dismissed his claim as “fallacious.”
Sampson declined to comment yesterday.
Meanwhile, a source told the feds that Smith boasted that the AEG casino would be his “golden parachute” when he left the Senate.
During his testimony, Smith insisted he did not play an active role in the Aqueduct selection process. But the IG report concluded that he was an AEG advocate who served as “AEG’s eyes and ears in the Senate.”
Smith, asked about the federal probe yesterday, denied any wrongdoing.
“Malcolm has committed no illegal activity whatsoever, nor has he been contacted by any law-enforcement agency in this matter,” said Smith spokesman Todd Shapiro.

       AN  ACT  to  amend the racing, pari-mutuel wagering and breeding law, in
         relation to abolishing the New York city and  Nassau  county  regional
         off-track betting corporations and establishing a reconstituted Metro-
         politan OTB

         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:

    1    Section 1. Subdivisions 1 and 3 of section 502 of the racing, pari-mu-
    2  tuel wagering and breeding law, subdivision 1 as amended by chapter  710
    3  of the laws of 1990, are amended to read as follows:
    4    1.  A regional off-track betting corporation is hereby established for
    5  each region, except the New York city [region] AND NASSAU COUNTY REGIONS
    6  for which [the New York city] A RECONSTITUTED NEW YORK CITY-NASSAU COUN-
    7  TY off-track betting corporation (HEREINAFTER, THE METROPOLITAN OTB), IS
    8  HEREBY established pursuant to and subject to article six of this  chap-
    9  ter  AND  shall constitute the regional corporation and such article six
   10  shall govern such [New York city]  RECONSTITUTED  NEW  YORK  CITY-NASSAU
   11  COUNTY off-track betting corporation. Each regional corporation shall be
   12  a  body corporate and politic constituting a public benefit corporation.
   13  Each corporation shall be administered by a board of directors  consist-
   14  ing  of  two members from each participating county containing a city of
   15  over one hundred fifty thousand in population,  according  to  the  last
   16  federal  census,  and  one  member from each other participating county.
   17  Notwithstanding any other provision of law to the contrary, the  members
   18  shall  be  appointed  by  the  county  governing  body,  and may, at the
   19  discretion of such governing body of counties which have a population of
   20  less than two hundred thousand, include sitting members of such  govern-
   21  ing body. A member of a governing body who is appointed a director after
   22  July  first,  nineteen  hundred  ninety  shall not be compensated by the

    1  regional corporation; provided, however, that the mayor  of  a  city  of
    2  over  one  hundred fifty thousand that has elected to participate in the
    3  management of a corporation pursuant to subdivision two of this  section
    4  shall,  with the approval of the city's legislative body, appoint one of
    5  the members to which the county containing such city is entitled. In the
    6  case of the corporation established for the Suffolk region  [and  Nassau
    7  region],  the  board  of  directors of each corporation shall consist of
    8  three members appointed by the governing body of [each] SUCH county, not
    9  more than two of whom shall be members of the same political  party.  IN
   10  THE  CASE  OF THE METROPOLITAN OTB, THE BOARD OF DIRECTORS SHALL CONSIST
   11  OF FIVE MEMBERS, TWO APPOINTED BY THE TEMPORARY PRESIDENT OF THE SENATE,
   12  TWO APPOINTED BY THE SPEAKER OF THE ASSEMBLY, AND ONE APPOINTED  BY  THE
   13  GOVERNOR, NOT MORE THAN THREE OF WHOM SHALL BE MEMBERS OF THE SAME POLI-
   14  TICAL  PARTY. Each director shall serve at the pleasure of the governing
   15  body or mayor appointing him, as the case may be. A  chairman  shall  be
   16  elected by the members to serve a term of one year.
   17    3.  Upon  the passage of enabling legislation by the governing body of
   18  not less than three counties within a region representing not less  than
   19  thirty  percent  of  the population of such region, as determined by the
   20  last federal census, or in the case of  the  Suffolk  region,  upon  the
   21  passage of enabling legislation by the governing body of Suffolk county,
   22  or  in  the  case  of  the  [Nassau  region]  METROPOLITAN OTB, upon the
   23  [passage of enabling legislation by the governing body of Nassau county]
   24  ENACTMENT INTO STATE LAW OF ENABLING LEGISLATION, or in the case of  the
   25  Mid-Hudson  region  upon  the  passage  of  enabling  legislation by the
   26  governing body of the county of Westchester and of the governing body of
   27  one other county in  such  region,  and  following  the  appointment  of
   28  members  of the board of directors, such corporation shall file with the
   29  secretary of state and with  the  state  racing  and  wagering  board  a
   30  certificate setting forth:
   31    a. The date of passage of the enabling legislation;
   32    b.  The  name  of  the  agency,  which shall be the name of the region
   33  followed by the words "regional off-track betting corporation"; and
   34    c. The names of the members of the board of directors and  the  chair-
   35  man.
   36    S 2. This act shall take effect immediately.
