ALBANY - New York's state lawmakers could soon be getting a raise.
Tucked within the $168 billion state budget approved last week is a measure that could clear the way for lawmakers, state agency commissioners and statewide elected officials to get their first pay increase since 1999.
Here's how it will work:
  • A five-member commission, led by Chief Judge Janet DiFiore, will by Dec. 10 decide whether to give lawmakers and top state officials a pay hike.
  • The raise would automatically take effect Jan. 1 unless lawmakers block or change it.
  • The commission could also approve cost-of-living increases through 2021.

Former Sen. Al D’Amato’s estranged wife claims he tried to “fix” their divorce case by dining with the state’s chief judge — and she’s got the photo to prove it.

“My husband bragged to me and others that he used his influence with Gov. Cuomo and his since indicted Chief of Staff, Mr. Joseph Percoco, to put Janet DiFiore on the bench,” D’Amato ex Katuria Smith alleges.
“He said that she owes him. In his mind it’s time for her to pay back by helping him to win his divorce and custody case,” Smith claimed.
She filed for divorce from her husband of 14 years last October. He then sued her for custody of their two young children.
She released the Pershing Square photo to the press Monday — just days after a different judge overseeing her Nassau County Supreme Court case removed her lawyer for trying to improperly influence the former couple’s kids.
D’Amato’s attorney, Stephen Gassman, called the allegations “unfounded and scandalous.”
He said D’Amato and DiFiore are “old friends who met for breakfast and talked about old times.”
They did not discuss the pending divorce case, Gassman said.

Current salaries

As it stands, New York's 213 state lawmakers receive a base salary of $79,500, though many also receive leadership stipends worth anywhere from a few thousand dollars to $41,500.
They also get a $175-a-night per diem for each night they spend in Albany.
The base salary is among the highest in the nation, trailing Pennsylvania ($86,479) and California ($104,118), according to the National Conference of State Legislators
