George Maragos and Joseph Mondello can't count to FREE

If George Maragos were a "real comptroller" he would put Attorney General Eric Schneiderman to work for an hour or so and see that a person with standing requests a FORMAL OPINION so that Nassau OTB could open 365 days of the year because Nassau County needs every dollar it can receive from Nassau OTB. It is clear to most of us that the State of New York can't determine when "Easter Sunday" is. See eg the Gregorian and Julian Calendars. There are many horse betting Republicans in Nassau County. Show us some love George and get that FREE FORMAL OPINION FROM ATTORNEY GENERAL ERIC SCHEIDERMAN NOW.


Dear Attorney General Eric Schneiderman:

    The Bettors of the State of New York and the employees of the remaining OTBs, public benefit corporations, have no standing to ask for your Opinion to the following simple questions with seemingly obvious answers::


1. Will the Attorney General defend the constitutionality of NY PML Sec 105?
2. Does NY PML Sec 105 apply to   Nassau OTB?
3. Does NY PML  Sec 105 violate the rights of New York Bettors secured by NY Const. Art. 1, Sec. 3?
4. Is NY PML Sec 105 vague, indefinite and/or overly broad as the term "Easter Sunday" does not define one and only one Sunday in all years (see eg Gregorian and Julian Calendars)?

I hope that you will sua sponte issue an Opinion as to the above so that bettors may bet, workers may work or not as they wish, and the State and its subdivisions make money. There are tracks running all across the United States every day of the year that bettors want to bet. Track calendars may be found at eg www.ntra.com. The OTBs also sell  New York Lottery tickets which are drawn every day of the year. The OTBs also cash non IRS Lottery tickets in cash for any sum, a convenience for many Lotto Players.

It is critical in these current time that the OTBs are open when customers want to bet. I believe that your Opinion will belatedly validate the actions of New York City OTB taken on the advice of its Counsel in 2003.

§  105. Supplementary regulatory powers of the board.  Notwithstanding
  any inconsistent provision of law,  the  board  through  its  rules  and
  regulations  or  in  allotting  dates  for  racing  or in licensing race
  meetings at which pari-mutuel betting is permitted  shall  be  empowered
  to:  (i)  permit racing at which pari-mutuel betting is conducted on any
  or all dates from the first day of January through the thirty-first  day
  of December, inclusive of Sundays but exclusive of December twenty-fifth
  and  Palm  Sunday  and  Easter  Sunday; and (ii) fix minimum and maximum
  charges for admission at any race meeting.

Nassau Republican Chairman Joseph Mondello endorsed George Maragos for U.S. Senate against Gillibrand at the county party’s annual victory brunch held at the Marriott Hotel in Uniondale on Sunday morning, January 22, 2012.
“Nassau Comptroller Maragos is the best and most qualified candidate for the US Senate,” stated Chairman Mondello. “George has a proven record as a business owner, running a successful business, and as a strong fiscal conservative. George is a proven leader with vision who can break through the partisan bickering in Washington, improve our economy, and put New Yorkers back to work.”
As Nassau County Comptroller Maragos has worked tirelessly to restore fiscal stability and accountability to County finances. Mr. Maragos has successfully applied his senior management experience in private industry to streamline government, reduce costs and eliminate waste while protecting our seniors, veterans and the needy.
“I am deeply honored and humbled by the endorsement and confidence of Chairman Mondello,” stated Mr. Maragos. “Gillibrand is obviously not doing the job for New Yorkers, for our middle class families, or for the unemployed. She consistently votes against the best interests of New York and its citizens. She voted to cut Social Security for our Senior Citizens when she voted against raising the debt ceiling, and she voted against middle class families with her support of ObamaCare, which is killing jobs and is costing small businesses many thousands of dollars. Lastly, her vote to pass the Dodd-Frank bill has destroyed over 200,000 good paying financial jobs in 2011 alone, according to the New York Times.”
“She has failed to address the decline in our children’s education, while school costs continue to rise to unaffordable levels. And let’s not forget that she has done nothing to alleviate the housing crisis, which she was partly responsible for creating when she worked at the HUD. Gillibrand has also failed to address the high cost of gasoline and home heating fuel by refusing to support a sound energy policy – one not dependent on foreign oil. What’s worse is that Gillibrand has done nothing meaningful to assist our upstate farmers and small businesses,” emphasized Maragos.
Chairman Mondello concluded “Mr. Maragos is a consensus builder with vision and experience to bring New York new manufacturing jobs, stimulate upstate investment to create jobs, fix our schools and achieve energy independence. Our senior citizens and middle class will be far better off with George Maragos in the Senate. Mr. Maragos has an MBA in Finance and a degree in Engineering. He is married to his wife for 38 years and has two children and two grandchildren.
