The Merger Provisions of the IBT Constitution are found at pp.71-72 of the Constitution. The members of Teamsters Local 858 represented the Managers of New York City OTB, a public benefit corporation, which went bankrupt. Local 858 also represents employees of Nassau OTB, a public benefit corporation.
Teamsters Local 858 is being merged with Local 707 without a vote of Local 858's members based on Decision(s) of the IBT.
A Nominating Meeting required by Local 858's By-Laws was not held in September.
Please provide me and each and every member of Teamsters Local 858 with copies of all decisions and supporting documentation made by the IBT regarding the merger of Local 858 and Local 707 without a vote and the alteration/suspension or other discontinuation of any and all provisions of Local 858's By Laws. Teamsters Local 858, Barry Yomtov President, has failed to provide written documentation of the actions and decisions taken by the IBT together with documents and/or evidence and/or communications from Teamsters Local 858 and 707. The members of Teamsters Local 858 do not possess copies of the Merger Agreement, if any, between the Locals. Barry Yomtov and Laura Campione et al will continue in positions, duties and compensation etc unknown to Local 858's members.
