Dear Brother:

Following discussions with management regarding your grievance pertaining to working 2 shifts on a single day, resulting in a three day workweek, the Executive Board is denying your grievance for the following reasons:

1.Past practice- It has been he practice since Nassau OTB's inception to deny such scheduling.

2. Article VI, Sec 13(c) of the Collective Bargaining Agreement gives Branch Managers the authority to override such requests. It also states, quite specifically: "In order of seniority each cashier will then select one desired shift for Monday through Friday." Granting a three day workweek would violate this section of the Collective Bargaining Agreement and give rise to grievances fro other cashiers who would not receive the same benefit.

3. If granted, it would establish a precedent wherein many cashiers would be in a position to schedule themselves for a three day workweek at the next annual pick.


4. There would be unintended adverse impacts upon the Collective Bargaining Agreement with respect to cashier breaks, utilization of annual leave, sick leave, bereavement and jury duty.
