On Sunday April 16, 2017 tracks are running across the United States that bettors want to bet. Nassau OTB employs lawyers and lobbyists and has standing to request opinions from the N.Y. State Attorney General.
NY PML Sec 109 does not apply to Nassau OTB, is vague, indefinite and or overly broad, is unconstitutional, and violates the rights of Nassau County bettors and Nassau OTB employees secured by N.Y. Const. Art 1, Sec 3.
I request that Nassau OTB open on Sunday April 16, 2017 and take all necessary legal actions to secure the rights of its customers et al. Counsel for NYC OTB asserted that NYC OTB had the right to open and make money in 2003 on Easter(s) Sunday(s). Nassau OTB's finances and handle are not robust enough to turn bettors and handle away.
The NY State Lottery and NY slot machines, VLT's, are open EVERY day of the year. Horse players must be free to bet at Nassau OTB whenever tracks are running outside the state of NY that they wish to bet.
